Terms.

TERMS & CONDITIONS

​

These terms and conditions, in addition to my privacy policy, constitute the entire agreement between you and Yogahimsa in relation to the services I provide either at the studio, on my website or elsewhere.

​

In these terms and conditions, the following definitions apply:

​

‘Yogahimsa’, ‘Me’ or ‘I’ means Sarah Helen-Kearvell, owner of Yogahimsa.

‘Class’ or ‘Classes’ means a class or classes provided by shYOGA either on a standalone basis e.g., single class, or as part of a class pack e.g. 5 class pass.

‘Clients’, ‘Yogis’ or ‘You’ means someone who has completed our registration form online, within the studio or through any other means.

‘Your’ shall be construed accordingly.

‘Studio’ means the location at which the class occurs.

‘Pack’ is a fixed number of classes over a fixed period paid for in advance before the start of the course at a discounted rate.

‘Single class’ refers to a single class booked in advance up to the start of the class.

‘Class pack’ refers to a fixed number of classes over a fixed period to be paid for in advance for any style of class offered.

By agreeing to these terms and conditions you are granted a personal, limited privilege to enter and the studio without prejudice to our other rights.

Please do not use any of these services if you disagree with any of these terms.

 

Booking classes

​

All classes must be booked and paid for in advance online through Instabook using your own account.

 

Cancellation

​

There is a 24 hour cancellation policy for all bookings. If you do not cancel 24 hours prior to the class, unfortunately you will be charged.  Please cancel via the Instabook or via email to shyoga.be@hotmail.com.

​

The cancellation policy applies to all services I offer, which are stated below:

10 class pack

Single class

Private class

​

The cancellation policy for workshops is slightly longer. If you wish to cancel a workshop space I require 72 hours advance in order to find someone else to take your space. If you do not cancel 72 hours prior to the workshop, unfortunately you will be charged.  Please cancel via the Instabook or via email to shyoga.be@hotmail.com.

If a yogi continually ‘late cancels’ i.e. cancels a class with less than 24 hours notice, I reserve the right to remove the Yogi from future classes.

​

Any cancellations made by myself or shYOGA outside the 24 hour window will result in an ‘early cancellation’ and you will be credited with another session.

If I cancel a class I will credit your account with a class, but no refund will be given.

 

Waitlist

​

If you sign up for the waiting list, and a space becomes available in the class you will notified via email. You will then need to cancel your current booking and re-book.

 

Refunds and validity

​

All classes must be booked in the name of the purchaser only and are not refundable once purchased unless there are extenuating circumstances. Courses must be booked using your own account.

​

The validity of the pack you are purchasing (including drop-in, 5 class pack, 10 class pack and private class packs) are located online at the point of booking on Instabook.

 

Class packs validity will not be extending, unless in the case of extenuating circumstances. If you are having problems with the validity, please get in touch via shyoga.be@hotmail.com

​

The validity period commences from the date you purchase the service.

​

This includes:

​

5 class pack – valid for 2 months

10 class pack – valid for 3 months

Single class – valid for 2 months

Private class – valid for 2 months (please email me with the date at shyoga.be@hotmail.com or discuss in person)

 

Refunds

​

If in the event of refunding one of the following at shYOGA (5 class pack,10 class pack, Single class, Private class or any workshop). You agree to allow up to 14 days from refund date to receive you money back.

You agree that you will only be refunded if you have cancelled your service within prior to the cancellation period stated for each service above.

 

Late comers

​

If you are running late for a class, please let me know via text (07980 948 636) or email (shyoga.be@hotmail.com)

​

You will not be admitted to the class if you are more than 5 minutes late and no refunds or class credits will be given.

​

Please be considerate of the other yogis taking the class. If you are under 5 minutes late and therefore admitted to the class, enter quietly. If you are later than 5 minutes, please do not disturb the other yogis by attempting to enter the class, please leave quietly.

 

Missed class

​

If you do not attend a class no refunds or class credits will be given if you failed to cancel 24 hours prior to the class.

 

Health and Safety

​

You acknowledge that you are fully aware that the participation in classes or workshops involves risks and that you accept all the risks of participating.

​

You affirm that you are in proper physical condition to participate in any activity associated with shYOGA and its classes and are aware that there are risks in participating in any physical activity, potentially that which could result in injury, serious injury or death.

​

If you have been found to suffer from high blood pressure, heart disease or any known contraindication, you may be requested to provide a letter from your doctor to shYOGA giving consent for you to take part in classes.

​

You agree to keep Yogahimsa informed verbally or in writing with any medical or health issues (including being under or over weight, falling pregnant, nursing, recent or pending operations, high or low blood pressure and anything else that may affect your ability to participate in class without risk to health and safety).

​

You agree to follow all instructions provided to you by the teacher as to when, where and how to perform and not to perform the yoga postures. It being understood that any deviation by you from the teacher’s instructions shall be at your own risk.

​

You agree to not to hold Yogahimsa responsible for any injuries, damages or losses suffered whilst practicing yoga with them. You agree to declare all injuries, illness, pregnancy and medication being taken whilst filling out the registration form. If any of these change you will make us aware as soon as possible.

​

You will notify me of any pain or discomfort felt during or before class.

​

As I am are not medically trained, I am not qualified to assess whether a person is in good physical condition or whether taking part in a class will be detrimental to their health.

​

A client should not enter the studio if they have any infections, contagious illnesses or diseases.

​

As part of the practice of yoga, adjustments or gentle touch may be applied to parts of the body during a pose and in “Savasana” to enhance the experience of relaxation or to deepen a stretch. If you are not comfortable to be physically adjusted and would prefer not to be touched during your practice then it is your responsibility to let the teacher know before or during the class.

​

Limitations Liability

​

I cannot be responsible for any loss, damage or theft of property, including bicycles left inside or outside the studio by you or any guests accompanying you.

​

All vehicles and bikes parked or locked outside of the premises are left at the owner’s risk and I cannot be held responsible for consequent losses or damage.

​

I cannot be held responsible for any personal injury, illness or, in the worst circumstance death which happens on our premises or because of our facilities or services provided.

​

I cannot be held responsible if classes, teachers or equipment are not available or for any changes which are made to classes or teachers last minute or without notice.

​

I do not accept any liability in connection with any third-party websites which may be linked or accessible through our own site, and we do not approve or endorse the content of such sites unless explicitly stated.

 

Age requirements

​

Minimum age to participate in any class is 12 years old at the time of registration

Yogis under the age of 18 at the time of registration are required to have their registration forms co-signed by their parent or guardian and must be accompanied by a parent, guardian or designated responsible adult during class.

​

Parents, guardians or designated responsible adults are responsible for the behaviour and health and safety of any child accompanying them.

​

Yogis agree to observe any signage within the studio and instructions provided.

​

In the event of a fire members must follow me and note the fire safety instructions and use the nearest exit available, leaving all belongings behind.

​

Yogis are required to dress appropriately and to walk on the studio floor bare footed only.

​

All shoes should be left in the designated shoe storage area.

​

By attending classes with Yogahimsa you may be asked for consent to having your photograph taken and being videoed from time to time. These may be used for social media or marketing purposes. If you do not want your photograph taken, please notify me at the time of request.

​

Yogis must notify Yogahimsa of any changes of address, email address or phone number. If such changes are not notified, I will presume that all communications and notices have been received.

​

You agree to notify Yogahimsa immediately if there is an unauthorised use of your Instabook or Stripe account or any other breach of security, but acknowledge that at all times you remain responsible for the confidentiality of your account and passwords.

​

I / Yogahimsa may communicate by email and by giving us your email, you give us consent to communicate with you in this way. I may on occasion host special offers or promotions, which may have different or temporary terms and conditions.

Any marketing, educational documents, website content, logo, pictures or other materials produced by Yogahimsa remain the property of Yogahimsa.

​

Any personal information that is given to me will be collected, stored and used in accordance with our Privacy Policy which is available through the website.

​

While I take all precautions to ensure your personal information is kept safe we cannot be held responsible for any unauthorised access.

In registering at Yogahimsa you have consenting to the privacy policy.

 

Prices and payment

​

Prices are listed on my website. If prices do change, you will be notified via my newsletter and can make the decision from there on whether to continue to purchase classes.

 

All payments on credit or debit cards will be made in pounds sterling and at the time of payment. I am not responsible for any additional charges levied by the individual financial institutions or credit card companies.
